We would like to bring to your attention a recent circular issued by the Maharashtra Government dated 14 May 2026 regarding strengthened implementation and inspection of compliance under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (“POSH Act”).
Through this circular, the government has authorised various district and state-level authorities to conduct inspections of establishments across Maharashtra, including private organisations, to assess compliance with the POSH Act. The circular also introduces a detailed POSH Compliance Checklist covering, inter alia:
- Constitution and composition of the Internal Committee (IC)
- POSH Policy dissemination and accessibility
- Employee awareness and IC training programmes
- Complaint redressal timelines and confidentiality measures
- Maintenance of records and annual reporting obligations
- SHE-Box portal onboarding and updates
- Employer responsibilities and inquiry timelines
The circular further states that non-compliance identified during inspection may attract penal consequences under Section 26 of the POSH Act.
In light of the above, organisations are advised to immediately review and strengthen their POSH compliance framework, documentation, training records, IC constitution, annual reports, and SHE-Box registrations/uploads.
We recommend conducting an internal compliance review/audit to ensure preparedness in the event of any inspection by the authorities.
