Case Study: Conducting Effective Workplace Investigations
Overview
The two-day in-person workshop, conducted for one of the largest audit and consulting firms, focused on:
1. Understanding ethical and legal obligations in workplace investigations.
2. Addressing compliance requirements, including the PoSH Act 2013, DPDP Act, 2023, and Companies Act, 2013.
3. Exploring best practices for handling sensitive cases, including harassment and whistleblower complaints.
4. Strengthening confidentiality, procedural integrity, and fairness in investigations.
This interactive session brought together professionals from Employee Relations, HR, Talent Relations, and Compliance teams to learn, discuss, and apply key principles of workplace investigations.
The Objective of Internal Investigations and Who Performs It
Internal investigations are conducted when companies detect or suspect misconduct, criminal activities, or policy violations. Common triggers include whistleblower complaints from employees or third parties, management suspicions, audit findings, or compliance obligations for multinational subsidiaries. Investigations may handle sensitive personal data, making it crucial for companies to comply with data protection laws and safeguard employee rights.
An investigation must balance thoroughness with confidentiality and efficiency. Supervisors, ER teams, HR personnel, in-house legal counsel, and special investigation committees may all play roles in leading investigations.
